Terms of Service

Plain language, no surprises. This is what you agree to when you join, buy, teach or sell on Holistic Music Academy.

Last updated 2026-09-30

These Terms of Service (the Terms) are an agreement between you and The Bailey Perspective (Holistic Music Academy is a Bailey Perspective company), based in Greenville, South Carolina, United States, which operates Holistic Music Academy at https://holisticmusicacademy.com (the Site). “We”, “us” and “HMA” mean The Bailey Perspective. “You” means the person using the Site.

By creating an account, ticking the agreement box, or using the Site, you accept these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

1.Your account

  • You must be at least 16 years old to hold an account. If you are under 18, a parent or guardian must agree to these Terms for you.
  • Use your real name or your artist name, and an email address you control. New accounts must confirm their email before they can be used.
  • You are responsible for what happens under your account and for keeping your password private. Tell us at admin@holisticmusicacademy.com if you think someone else has used it.
  • One person, one account. Accounts created by bots, or to impersonate someone, will be removed.

2.Memberships and billing

HMA offers paid memberships (such as HMA Plus, The Grove, Patron and the Founding Lifetime pass). Prices are shown on the Site before you buy and are in US dollars unless stated otherwise.

  • Renewal. Monthly and yearly memberships renew automatically at the end of each period, and your card is charged the price shown when you subscribed, until you cancel.
  • Cancelling. You can cancel any time from Settings (“Manage billing”). You keep access until the end of the period you have paid for. We do not refund the unused part of a period.
  • Lifetime. A Founding Lifetime pass is a one-time payment for access for as long as HMA runs the service it covers.
  • Price changes. If we change a membership price, we will tell you by email at least 30 days before it applies to you.
  • Payments are processed by Stripe. We never see or store your full card number.

3.Courses, tools and other purchases

  • When you buy a course, a tool (such as the Grove tools or Song Vault), a mentorship seat or another product, you get a personal, non-transferable licence to use it for your own learning and music-making. You may not resell, share your access, or redistribute what you bought.
  • Courses and products made by other members are theirs. HMA hosts them and takes payment for them; the member who made them is responsible for their content and accuracy.
  • Mentorship groups and live courses run on the dates and in the form described on their page. If we have to cancel a session or a group, you get a refund for what did not happen.
  • Some things on the Site are free, and some free features may have limits. We can change what is free and what is paid, but we will not take away something you have already paid for.

4.Refunds

  • Memberships: cancel any time; no refunds for the part of a period already paid for, except where the law requires it.
  • One-time purchases (courses, tools, downloads, Lifetime): email admin@holisticmusicacademy.com within 14 days of buying. If something did not work as described, or you could not access it, we refund it. We may decline a refund where the material has been substantially used or downloaded.
  • Refunds go back to the card you paid with. When a refund is made, access to the refunded item ends.
  • Nothing here limits any rights you have under the consumer law where you live.

5.Teaching and selling on HMA

Members can publish courses and, over time, other products on the Site (a Provider). If you do, this section applies to you as well.

  • The split. For every sale of your course or product, you receive 70% of the price the student paid. HMA keeps 30%, which covers card processing, hosting, and the platform. We can change this split with at least 30 days’ notice by email; the change applies to sales after that date.
  • Getting paid. Payouts are made by Stripe to a Stripe account you set up from your dashboard, in your own name and with your own bank details. Stripe verifies your identity and holds your bank details, not HMA. Stripe pays out on its regular schedule. You must agree to Stripe’s Connected Account Agreement when you set it up.
  • Refunds and chargebacks on your sales come out of your share in the same proportion. If your Stripe balance cannot cover one, we may set it against your future sales.
  • Taxes. You are responsible for reporting and paying any taxes on what you earn. Stripe may ask you for tax information and may issue tax forms where required.
  • Your promises. You own or have the rights to everything in your course or product (including samples, images and music); it is accurate and honestly described; it does not infringe anyone’s rights or break the law; and you will look after the students who buy it.
  • Our rights. We can decline, hide or remove a course or product that breaks these Terms, is misleading, or harms the community, and we can end a Provider’s selling rights for repeated problems. Money already earned on completed sales stays yours, less any refunds.
  • Pricing. You set your own price within the limits shown in the course builder. Prices are shown to buyers in US dollars.

6.Your music and your content

  • It stays yours. You keep every right to the music, recordings, artwork, lessons, posts and anything else you upload or make on HMA, including what you make with the Grove tools.
  • What you let us do. So the Site can work, you give us a non-exclusive, worldwide, royalty-free licence to host, store, stream, display and share your content on the Site and in HMA’s own channels (for example, featuring a track in the Library or on our social accounts). This licence ends when you delete the content or your account, except where it has already been shared by others in ways you allowed.
  • No AI training. We will never use your music or content to train, fine-tune or evaluate artificial-intelligence or machine-learning models, and we will never license it to anyone else to do so.
  • Other people’s rights. Only upload what you have the right to upload. If someone tells us their rights have been infringed, we may remove the content and ask you about it; repeat infringers lose their accounts. To report an infringement, email admin@holisticmusicacademy.com with the details.

7.Community conduct

HMA is a place for musicians to learn and grow together. Please do not:

  • harass, threaten or discriminate against anyone;
  • post spam, scams, or advertising unrelated to music;
  • upload malware, or try to break, overload or scrape the Site;
  • pretend to be someone else, or share another member’s private information;
  • post anything illegal, or that infringes someone else’s rights.

We may remove content and suspend or close accounts that break these rules.

8.HMA's own content

The Site’s design, code, name, logos, courses and materials made by HMA, and The Grove (its world, characters, art and tools) belong to The Bailey Perspective or its licensors. You may use them as part of the Site and, where you have bought them, under the licence in section 3. You may not copy, sell or build on them without our written permission.

9.Ending your account

  • You can close your account at any time from Settings, or by emailing admin@holisticmusicacademy.com. Active memberships end at the close of the paid period.
  • We can suspend or close an account that breaks these Terms, or if we are required to by law. If we close your account for a reason that is not your fault, we refund the unused part of any paid membership.
  • Sections 5 (money already earned and owed), 6, 10, 11 and 12 continue to apply after an account is closed.

10.What we don't promise

We work hard to keep the Site running well, but it is provided “as is”. We do not promise it will always be available, error-free or suit a particular purpose, and we do not promise any particular result from a course, a tool or a mentorship. Advice on the Site is educational; decisions about your music, career and money are yours.

11.Limits on our liability

To the extent the law allows, The Bailey Perspective and the people who work with us are not liable for indirect, incidental or consequential losses (such as lost profits or lost data) arising from the Site. Our total liability to you for anything connected with the Site is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

If you are a Provider, you agree to cover us for claims that arise from your course, product or content breaking these Terms or infringing someone’s rights.

12.Disputes and governing law

  • These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-law rules.
  • If something goes wrong, email admin@holisticmusicacademy.com first. We will try to sort it out with you informally within 30 days.
  • If that does not work, disputes are heard in the state or federal courts located in the State of South Carolina, and you agree to their jurisdiction, unless the consumer law where you live says otherwise.

13.Changes to these Terms

We may update these Terms as the Site grows. When a change matters to you (for example, prices, the Provider split, or what you let us do with your content), we will email you at least 30 days before it takes effect. The date at the top shows the current version. Using the Site after a change takes effect means you accept it.
